These Terms and Conditions ("Agreement") govern your access to and use of the Twentysix.cloud platform ("Service"), which is a SaaS solution provided by Aleph Cloud, located at Aleph SASU, 242 Boulevard Voltaire, 75011 Paris, France. By using the Service, you agree to comply with these terms. If you do not agree, you may not use the Service.

1. Definitions

• "User" refers to any individual or entity accessing the Service.

• "Customer Data" means any data that you upload or input into the Service.

• "Subscription" refers to the access granted to Users through NFTs for a specified period.

2. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization.

3. Access Rights

• You are granted a non-transferable, non-exclusive right to access and use the Service during the Subscription Term through an NFT minted in your wallet.

• You must ensure that all Users comply with this Agreement.

4. Customer Obligations

• You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

• You must ensure that any Customer Data complies with applicable laws and regulations.

5. Compliance Regulations

Participants granted access to Twentysix.cloud must adhere to the following compliance regulations:

• Non-Criminal Activities: The cloud services may only be used for legal and non-criminal activities. Any engagement in illegal activities is strictly prohibited.

• Anti-Discrimination: Users must not discriminate against any individual or group based on race, gender, religion, nationality, sexual orientation, or any other protected characteristic.

• Data Storage Compliance: Participants are prohibited from storing any illegal data on the platform, including data that violates intellectual property rights or contains harmful content.

• Data Protection and Privacy: Users must comply with all applicable data protection laws, such as GDPR and similar regulations in other jurisdictions. However, due to the open-source nature of Twentysix.cloud, we cannot guarantee reasonable safeguards for Customer Data.

6. Fees and Payment

There are no fees associated with accessing the Service. NFTs that grant access will be provided to participants upon acceptance into the program.

7. Data Protection

Participants are unable to provide Twentysix.cloud access to Customer Data due to the decentralized nature of the platform. As such, it is impossible for Twentysix.cloud to implement reasonable safeguards over Customer Data.

8. Confidentiality

Both parties agree to keep confidential any proprietary information received from the other party during the term of this Agreement.

9. Termination

Due to the decentralized nature of Twentysix.cloud, there is no termination possibility from our side. Participants can choose to remove all solutions from their account at any time if they decide to stop using the service.

10. Limitation of Liability

Twentysix.cloud is open-source and decentralized; therefore, it cannot be liable for any damages incurred by users or third parties as a result of using the Service.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting on our website. Continued use of the Service after changes indicates acceptance of those changes.

13. Miscellaneous

This Agreement constitutes the entire agreement between you and us regarding its subject matter and supersedes all prior agreements. If any provision is found invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions.

By using Twentysix.cloud, you acknowledge that you have read these Terms and Conditions and agree to be bound by them.
